Requirement for Annual Report to the Virginia Real Estate Board

Please be reminded that all associations must provide an annual report to the Virginia Real Estate Board as required by Section 55-79.93(1) of the Virginia Condominium Act and Section 55-516.1 of the POAA. This creates a state database for all associations and is available to the public.

Is this database available, and if so, where? I have been unable to locate it on the REB web site.

RESPONSE: You can determine if an association has filed their annual report by going to www.dpor.virginia.gov and clicking on "License Lookup". From there you will have to complete item 1 by checking the box under "property registration" and then completing item 2 by entering either the name of the Association or the zip code and clicking on "Search".

Do Condo Association Board members who own apartments that they rent out to tenants have to be resident themselves to be on the Board? Several people running for board membership are realtors or speculators who do not live in the condo complex but are making or will be making some major financial decisions that they might not do if they lived with their neighbors.

RESPONSE: Dan, As in the case of many questions asked of us, the answer lies in your documents...specifically your bylaws. Generally bylaws allow any owner to serve on the board, some bylaws also require directors to be resident owners. If the bylaws do not specifically require a director to be a resident, then any owner can serve.
